Simply put, a Gun Trust is a special revocable living trust designed to hold firearms. A Gun Trust can be a smart way to hold Title II firearms. Title II firearms could include suppressors/silencers and machine guns. A gun trust allows the trustees to legally possess title II weapons. However, after July 2016 all “responsible persons” of the trust or anybody “who has the power and authority to direct the management and policies of the trust or legal entity to receive, possess, ship, transport, deliver, transfer, or otherwise dispose of an NFA item for, or on behalf of, the trust or entity” must submit photographs and fingerprints to the chief legal officer. A gun trust allows multiple people to use a title II firearm and can allow heirs to inherit said guns legally if the trust is set up properly.
